Public Utilities Commission Attempts Extortion Through Fear.
It seems that the public utilities Commission (PUC) Is going after small businesses that offer labor Services. A small (licensed) Business providing Moving Labor (ie: loading & unloading labor) has received notice from the PUC to "Cease & Desist Operations".
The Labor Service company, in it's advertisement, Does not advertise, state, or give impression, that it is a moving company or mover of used household goods. It DOES however list it's business name, business license, Insurance company, Operation license and other information to show that it is a legal business.
The PUC does say that the company can obtain a PUC household goods transport application & license (for a nominal fee of $500.00) or be shut down, face imprisonment and have a $1000.00 fine imposed.
Again, the labor service company does NOT advertise as a household goods carrier and the PUC has no authority to extort, threaten or instill fear into businesses, or individuals that do not fall under their Nazi regime.
The PUC also has threatened other Labor services with Telephone disconnection if the PUC even thinks that the individual (or business) might be transporting goods.
The business owner states "My advertisements say Materials Included and the PUC says "that's what a moving company would put in their ads, so you can't say that ".
The PUC also states that since this particular moving labor service offers it's customers the same amount of insurance that moving companies offer (but at a cheaper rate) it Must be advertising as a moving company.
The business is licensed, offers insurance to it's customers, has all permits needed to operate and has workers comp. it provides construction cleanup labor, foreclosure trash-outs, loading & unloading labor...none of which falls under the authority of the PUC.
How many other businesses or individuals has the PUC attempted to extort with "either pay us or suffer the consequences" ?
The PUC has NO authority for:
1. Labor only.
2. Pickup & Delivery from any vendor, store, thrift shop.
3. Pickup & Delivery of New items.
4. Office or Commercial Moves (including in home offices).
5. Advertisements (unless stated that you are a carrier or moving company)
Scenario:
An elderly disabled woman must move, but can't afford to.
A neighbor (also the woman's caregiver) decides to use his truck and help her move 1 piece of furniture and a few boxes, at no cost to the woman.
The PUC says that this is illegal because the neighbor hasn't payed the PUC $500.00 to get his movers license.
The PUC gets a court order to have the neighbors phone shut off (until he gets a PUC license). Since he used his vehicle, the PUC determines that the neighbors pickup truck is a public nuisance and it's confiscated & given to the state.
The neighbor is given up to 1 year in jail, a $1,000.00 fine (the PUC gets their "kickback") and pays court costs in the thousands of dollars.
All because he did the right thing. And the PUC has a chance to make some money...not to mention that they've just increased their chances of getting more federal funding.
Why don't they go after the scammers & ripoff moving companies?
Because those ripoff moving companies payed the $500.00 protection money!
